Agreement to Terms: By accessing or using our website, services, and submitting quotes, you agree to be bound by these Terms and Conditions and our Privacy Policy.
Capacity: You confirm you are at least 18 years old or possess legal parental or guardian consent and are fully able to enter into and comply with these Terms.

Service Descriptions: We provide information regarding equipment rental, equipment sales, and logistics/site services (Excavation, Hauling, Moving). All detailed service provision, pricing, delivery, and guarantees are governed by a separate, written Rental Agreement or Service Contract signed by both parties.
Website Information: While we strive for accuracy, equipment availability, pricing, and specifications listed on the website are subject to change without notice. The final, binding terms are those presented in the official, executed contract.

Rental Contract: Every rental requires execution of our Master Rental Agreement.
Customer Responsibility: You are fully responsible for proper use, operation, maintenance, and safekeeping of the equipment from pickup/delivery until return.
Return Condition: Equipment must be returned full of fuel ($20/gallon refuel + labor), clean ($175/hour cleaning), fully operational, and with all keys (lost key fee $350).
Insurance: You must provide a Certificate of Insurance naming MIGHTY MACHINE RENTALS LLC as additional insured with general liability limits of no less than $1,000,000 per occurrence prior to delivery. You must give 30 days’ notice of any cancellation or reduction. Failure to provide proof allows us to withhold equipment without liability.
Optional Equipment Damage Waiver: Available for 15% of the total order. This is not insurance. It modifies some responsibility for accidental damage during normal use but has a deductible ($500 or 10% of repair cost, whichever greater) and major exclusions (theft, misuse, neglect, rollover, tires/tracks, overhead damage, etc.). Full details in the Rental Agreement.

This establishes the conditions for equipment sales.

Sales Conditions: All equipment sales are made on an "AS IS, WHERE IS" basis, unless expressly warranted otherwise in a separate, written Bill of Sale or Warranty Document.
Inspection: Buyers are strongly encouraged to inspect the equipment and are responsible for confirming the condition, specifications, and hours before purchase.
Finality of Sale: Once executed, equipment sales are generally final and non-refundable.

Ownership: All content on this website (logos, images, descriptions, text) is the property of Mighty Machine Rentals and is protected by copyright law.
Prohibited Use: You may not copy, reproduce, or use the website content for commercial purposes without our express written consent.

This section aims to protect the company from legal claims related to website use or service outcomes.

Limitation of Liability: The company will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the website, or from the use or malfunction of rented or purchased equipment, beyond what is covered by the separate rental/service contract.
Indemnification: You agree to indemnify, defend, and hold harmless the company against all claims, liabilities, and expenses arising from your use of the services or breach of these Terms.

Governing Law: These Terms shall be governed by the laws of the State of California.
Dispute Resolution: This usually includes a clause requiring arbitration or mediation before litigation.
